Welcome to HostingMarks.com (“HostingMarks,” “we,” “us,” or “our”). HostingMarks is a sister company of Maryam’s Mark and Co. LLC and operates in connection with R Family Holding LLC. By accessing or using our services, you agree to be bound by the terms and conditions outlined in this User Agreement (“Agreement”). Please read this Agreement carefully.

1. Acceptance of Terms

By registering for, accessing, or using any services provided by HostingMarks, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you must not use our services.

2. Eligibility

You must be at least 18 years of age to use our services. By using HostingMarks, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement.

3. Account Registration and Security

When you register for an account with HostingMarks, you agree to:

  • Provide accurate, current, and complete information. 
  • Maintain the security of your password and identification. 
  • Promptly update your account information to keep it accurate and complete. 
  • Accept all risks of unauthorized access to your account and any information you provide to HostingMarks. 

4. Services Provided

HostingMarks offers a variety of services, including but not limited to:

  • Domain name registration and management. 
  • Web hosting services. 
  • Email hosting. 
  • Website building tools. 

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

5. User Responsibilities

As a user of HostingMarks, you agree to:

  • Comply with all applicable laws and regulations. 
  • Use our services only for lawful purposes. 
  • Not engage in any activity that interferes with or disrupts our services or servers. 
  • Maintain backups of your content to prevent data loss. 

6. Payment and Billing

All fees for HostingMarks services are due in advance and are non-refundable, except as otherwise provided in our Refund Policy. You authorize HostingMarks to charge your chosen payment method for all applicable fees.

7. Term and Termination

This Agreement will remain in effect until terminated by either party. You may terminate this Agreement at any time by discontinuing use of our services and closing your account. HostingMarks may terminate or suspend your access to services at any time, with or without cause or notice.

8. Intellectual Property

All content and materials provided by HostingMarks, including but not limited to text, graphics, logos, and software, are the property of HostingMarks or its licensors and are protected by intellectual property laws. You agree not to reproduce, distribute, or create derivative works from any HostingMarks content without prior written permission.

9. Limitation of Liability

HostingMarks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability to you for any claim arising out of or relating to this Agreement shall not exceed the amount paid by you to HostingMarks in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless HostingMarks, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of our services or violation of this Agreement.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law principles.

12. Changes to the Agreement

HostingMarks reserves the right to modify this Agreement at any time. We will notify you of any significant changes by posting the new Agreement on our website and updating the effective date. Your continued use of our services after any changes constitutes your acceptance of the new terms.
